1. Scope

1.1 Provider

1.2 Application

These Terms of Service govern the use of the mobile application CoachingTrackr (hereinafter "App") for:

•iOS (iPhone, iPad)
•macOS
•visionOS

The Terms of Service apply to all users of the app, regardless of whether they use the app free of charge or for a fee.

2. Contract Formation

2.1 Download and Installation

The contract for the use of the app is formed through:

Download of the app from the Apple App Store
Installation on your device
First use of the app (implicit acceptance of these Terms of Service)

2.2 Beta Version (TestFlight)

If you use the app via TestFlight as a beta version:

•The app is in development
•Features may be faulty or subject to change
•You agree to provide feedback
•Use is at your own risk
•There is no claim to uninterrupted availability

3. Scope of Services

3.1 App Features

CoachingTrackr offers the following main features:

Client Management:

•Collection and management of client master data
•Contact information and communication history
•Import contacts from the Contacts app

Coaching Management:

•Planning and documentation of coaching sessions
•Intake questionnaires with encrypted storage
•Notes and diagnoses (end-to-end encrypted)
•Goal setting and progress tracking
•Task management

Data Security:

•End-to-end encryption for sensitive health data
•Local data storage
•Optional: iCloud synchronization
•App lock with Face ID/Touch ID

4. Pricing and Payment

4.1 Free Usage (Freemium Model)

CoachingTrackr is available for free in its standard version:

Up to 3 clients
Up to 3 sessions per client
All basic features

4.2 Pro Version

The Pro version offers unlimited functionality:

•Subscription: Monthly or annual payment
•Lifetime: One-time payment

4.3 Payment Processing

Payments are processed through Apple In-App Purchase. Apple Media Services Terms of Service apply.

5. User Rights and Obligations

5.1 Right of Use

You receive a non-exclusive, non-transferable, revocable right to use the app for personal purposes.

5.2 Permitted Use

You may use the app for:

Managing your own coaching practice
Organizing your clients
Documenting coaching sessions
Installation on max. 5 devices per Apple ID

5.3 Prohibited Use

You may not use the app for:

Illegal purposes or rights violations
Reverse engineering or decompilation
Bypassing security mechanisms
Resale or rental of the app

5.5 Data Protection Towards Your Clients

If you use the app to manage client data, you as a user are responsible for:

•Obtaining consent from your clients for data processing
•Compliance with GDPR and other data protection laws
•Informing your clients about data processing

We are not responsible for your compliance with data protection laws towards your clients.
